Trading Terms and Conditions


General

These terms apply to all sales by DMS Products to the exclusion of any other terms unless otherwise agreed in writing.

DMS Products reserves the right to make changes to the items shown on this website and to remove selected styles.

We have made every effort to ensure that the colours and images used on this website give a good representation of the products themselves, but we cannot guarantee this due to monitor resolution/brightness.

Delivery
Stock items ordered will normally be dispatched within 2 days of receipt of order using our standard two working day delivery service.

Anticipated delivery dates for non-catalogue standard or personalised garments may be confirmed at the time of ordering. Unless agreed in writing time is not of the essence.

DMS Products reserves the right to deliver the goods in reasonable instalments, in which case you shall accept and pay for the goods in reasonable instalments. Each instalment is to be treated as a separate contract.

Any claim for non-delivery of or damage to the goods in transit should be made within seven days of the date of the invoice for them. Our liability in respect of any such claim is limited at our option to replacement of the goods or refund of the price and does not extend to any indirect or consequential loss.

It is our normal policy to despatch orders between 1-2 working days of receipt of order via a national courier network.  We aim to despatch orders as quickly as possible.

We can also deliver your items to a different delivery address to your billing address by amending the delivery address in the checkout pages. You can also save multiple delivery addresses for a faster checkout experience the next time you order.

FREE SHIPPING!   on orders of £100 or more

Look for the logo to enjoy free shipping on selected items throughout the store. If the items in your order which qualify for 'Free Shipping' total £100 or more, your order is sent carriage FREE!.

Normal carriage charge is £4.95 per consignment and most parcels are sent out via the CityLink network on a next day service.  Items up to a certain weight and value may be sent via the Royal Mail netowrk.

Extra charges will apply for overseas.  Please enquire from our sales office.

Price
The price of the goods will be the price ruling at the date of dispatch. All prices quoted exclude post & packing and VAT (unless you have selected to view prices including VAT). Any applicable post & packing and VAT is payable by you in addition to the contract price.

Orders will incur a post & packing charge for deliveries within of mainland UK.  A quotation can be provided for deliveries outside of the UK.

A next day service, providing delivery by 5pm the next working day (Mon-Fri only), is available within most areas of the UK at a cost of £4.95 plus VAT per package, inclusive of any post & packing charge, up to a maximum weight of 25kg per package. Orders must be received by 2pm.

In areas affected by a congestion charge, a surcharge of 50p plus VAT per order may be added. In the event that the carrier is unable to deliver to you and a second delivery journey is required, or if the second attempted delivery is unsuccessful, in which case the goods will be returned to DMS Products, additional carriage charges incurred may be charged to you.

DMS Products will not be liable for any consequential loss caused by failure of the carrier to deliver.

Any other additional services such as embroidery or other personalisation of garments, alteration to garments, manpacking etc. will incur an additional charge. Prices for these services will be confirmed at the time of ordering.

Payment
If you have a credit account, invoices will be issued on the day of dispatch of the goods and must be paid within thirty days of invoice date, subject to status.

If you fail to pay us in full on the due date:

•We may suspend or cancel future deliveries;
•We may cancel any discount offered to you;
•You must pay us interest at the rate equivalent to that set for the purposes of Section 6 of the Late Payment of Commercial Debts (Interest) Act 1998;
•Calculated (on a daily basis) from the date of our invoice until payment;
•Compounded on the first day of each calendar month;
•We may cancel any discount offered to you;
•Before & after any judgement (unless the court orders otherwise).
If you have not paid DMS Products all amounts due on an invoice and 45 days have passed since the due date for payment then DMS Products has the right to charge you an administrative fee.

Where copy invoices are requested faxed copies will be provided free of charge but there will be a charge of £1 plus VAT for copies required to be sent by post.

You are to indemnify DMS Products in full and hold DMS Products harmless from all expenses and liabilities DMS Products may incur (directly or indirectly and including finance costs and legal costs on a full indemnity basis) following any breach by you of any of your obligations under these terms. You are not entitled to set off any debt or claim against other amounts owing to us.

Risk & ownership
The risk in the goods passes to you when the goods are delivered to the delivery address. Ownership of the goods remains with DMS Products until payment has been received in full for the goods and any other garments for which payment is also due.

Your data
From time to time we may make our mailing file available to carefully selected companies whose products may be of interest to you. If you do not want us to pass on your details, please write to our customer care department at our Central Sales Office or email us at sales@dms.uk.com or phone 0800 018 14 10.

Insolvency
If (a) you make any voluntary arrangement with your creditors or become bankrupt or become subject to an administration order, or go into liquidation; (b) you cease, or threaten to cease, to carry on business; or (c) DMS Products reasonably believes that any of the above events is about to occur and notifies you accordingly; then you shall cease at once to use any goods not then paid for and shall on demand return any of them remaining in your possession.

On making such a demand, we are entitled, without incurring any liability to you, to enter your premises and remove and repossess such of our goods as are to be found there, and also to cancel any contract with you.

Force majeure
Where we are unable to perform due to any circumstances beyond our control we may suspend performance while those circumstances subsist and any agreed date or period for delivery shall be regarded as extended accordingly. If any period of suspension of deliveries lasts for more than three months, either party may cancel the contract by written notice without penalty.

Returns policy

Items correctly supplied

We understand that mistakes can happen and that you may have inadvertently ordered the incorrect size. 
It is the responsibility of the customer to return the items in question at their cost.
Garments which have been embroidered, printed or decorated in any way cannot be returned.
Items specially made to customers special orders cannot be returned to stock.

Exchanges for Account customers

We are happy to exchange for the correct size but due to the high cost of admin work we have to make a charge.
Items for return must be sent back withing 7 days of receipt.
Goods supplied correctly but ordered incorrectly by an Account customer will attract a restocking charge of 10%.

Exchanges for Retail Customers

Retail customers who pay list price can exchange free of charge.
Items for return must be sent back withing 7 days of receipt.
In each case it is the responsibility of the customer to return the items in question at their cost.
Garments which have been embroidered, printed or decorated in any way cannot be returned.
Items specially made to customers special orders cannot be returned to stock.

Refunds for Retail Customers

We want you to be happy with every purchase but if you need to return an item it's a straightforward process.  We are happy to refund in full for any unworn or unused item returned in original condition within 7 days or for faulty goods received - just follow the steps below.

3   Arrange dispatch with the courier of your choice taking care to obtain a receipt for your package.

DMS Products will not be held liable for the loss of any returned items/parcels. We recommend that you obtain Proof of Posting and take out adequate parcel insurance to cover against consequential loss by your courier.

b) Incorrect, fauly or missing items

In the unlikely event that you receive goods which were not what you ordered or which are damaged or defective, or are of a different quantity to that stated on your order form, we will gladly make good any shortage or non-delivery, refund, replace or repair any damaged or defective goods, provided that you notify us of the problem within 3 working days of delivery of the goods.

At our discretion, we may collect goods for inspection before making a decision. This does not affect your statutory rights.

Our policy is normally to refund, rather than replace. At our discretion this may be as a payment or credit on your account. If you require a replacement item, we would advise you to make a separate order RETURNS To enable us to handle your return as quickly as possible, please follow the simple instructions below:

1. Please contact our Customer Services Team on 0845 200 1525 or sales@dms.uk.com and request a Returns Form which must be completed with details of the reason for return, and send it back to us with the product.

2. Wrap the package securely and address it to the following: DMS Products, 2 Queen Anne Drive, Edinburgh, EH28 8LH, for attention of Customer Service.

3. We recommend you keep a receipt of postage, as we cannot be held responsible for items which may get lost in the post.

4. We will notify you via Email, Telephone or Letter when we have processed your return. This may take up to 10 working days from receipt of the returned item.

Cancellation
If an order for a bespoke style, personalised or altered garment is cancelled for any reason you will be charged for any garment, labour or fabric costs that have been incurred in processing the order up to the time of cancellation.

Warranties & liability
DMS Products warrants that the goods will correspond with their specification and will be free from defects in material and workmanship. In addition, garments constructed from speciality workwear fabric will be guaranteed for a period of twenty four months from purchase. Both of these warranties are subject to the following conditions:

•DMS Products shall not be liable; (i) in respect of any defect arising otherwise than from fair wear and tear, or arising from wilful damage, negligence, failure to follow care instructions, abnormal working conditions, misuse or alteration; (ii) if the total price for the goods has not been paid by the due date; (iii) if the defect arises from any drawing, design or specification supplied by the customer.
•Where goods are faulty, DMS Products shall replace the goods free of charge, rectify the fault, or refund the price of the goods, and DMS Products shall have no further liability. For any sales covered by the Consumer Protection (Distance Selling) Regulations 2000 the customer has the right to request a refund.
•DMS Products shall not be liable for any loss or damage whether direct or consequential or otherwise but in any event DMS Products's liability (if any) shall be limited to the price of the goods.
•Nothing in these terms affects DMS Products's liability for death or personal injury resulting from DMS Products's negligence.
•Nothing in these terms affects your statutory rights.
Samples
For approved account customers, samples requested will be invoiced on dispatch and will be credited in full provided they are returned to us unused within thirty days of delivery otherwise the price, including any applicable post & packing and VAT becomes immediately payable.

Rental
Any garment supplied under a rental or hire purchase agreement will be covered by separate Terms & Conditions.
